Terms & Conditions (T-2026-A)

Age & Geographic Requirements

• Users 18+ can enroll without restrictions
• Users under 18 require parental/legal guardian consent (see Privacy Policy P-2026-A, Section 09)
• Certain programs may have regional restrictions due to regulatory requirements (check specific Program Page)

Enrollment & Account Creation

1. You provide accurate personal information (name, email, phone, location)
2. You select your simulation lab program and cohort dates
3. You complete payment through authorized payment partners
4. Upon payment confirmation, your enrollment is activated and lab access begins
5. You receive login credentials via email

Inactive Enrollment: If you do not access the Platform within 7 days of enrollment, we may cancel your enrollment and process a refund per the Refund Protocol (R-2026-A).

Your Account Responsibility

You are solely responsible for:

• Maintaining confidentiality of your login credentials
• All activities conducted under your account
• Reporting unauthorized access immediately to support@simulpus.org

You agree not to:

• Share credentials with others
• Create multiple accounts to circumvent policies
• Impersonate other users
• Use fake or misleading enrollment information

Program Duration & Lab Access

Program curricula, duration, and structure vary by simulation lab program. Please check your specific Program Page for:

• Curriculum details
• Program duration
• Lab structure and weekly targets
• Total lab access period
• Completion deadlines

What "Unlimited Practice" Means

You can retake any lab unlimited times during your access period to achieve your target score. You can crash and reset the server 100 times to get the perfect score without limitations or penalties.

Resource Consumption: However, consuming >20% of Program Milestones is considered consuming the course value (see Refund Protocol R-2026-A, Section 04).

Technical Requirements & Limitations

Supported Devices:

• Desktop/Laptop with modern browser (Chrome, Firefox, Safari, Edge)
• Stable internet connection (5 Mbps minimum recommended)
• For Instrument-Level programs: USB port for ergonomics kit connection

Simulpus is NOT responsible for:

• Your slow internet or outdated hardware
• Your local internet infrastructure failures
• Browser or OS compatibility issues on your end

Session Persistence: If you disconnect during a lab, your session state is automatically saved. You can resume from where you left off within the saved session window.

Course Pause & Extensions

What the AI Mentor Does

• Teaches concepts in your preferred vernacular language
• Provides instant doubt clarification via chat or voice
• Gives real-time, context-aware feedback with 100% technical accuracy
• Remembers your progress and references past mistakes
• Motivates like a senior mentor beside you

What the AI Mentor Is NOT

The AI Mentor is a training simulation tool, not a licensed professional consultant. It is not approved for real-world professional application without human oversight.

You acknowledge: Simulpus training is for skill-building and professional development in a risk-free simulated environment, not for immediate real-world deployment.

Grading & Grade Appeals

If you believe a lab was graded incorrectly:

1. Go to your Dashboard and submit a Grade Appeal Ticket
2. Include: Lab name, session details, and your reasoning
3. A human engineer reviews your session logs within 24 hours
4. If the AI was wrong, your score is manually corrected
5. Grade corrections are NOT grounds for refund (technical corrections only)

Stuck on a Lab? Human Handoff Protocol

• The system automatically detects a Loop Pattern (same hint given 3+ times with no progress)
• Your session is flagged for human engineer review
• Alternatively, raise a Priority Support Ticket if blocked for >24 hours
• A human engineer will assist within 2 to 24 hours

Language & Accessibility

• Toggle AI Mentor language in settings (English, Hindi, Telugu, Kannada, Tamil, etc.)
• Context preserved across language switches
• Technical terms remain in English for global employability and standardization
• Extended time available for documented learning disabilities upon request
• AI Mentor supports Text-to-Speech (TTS) and Speech-to-Text (STT) for accessibility

Medical & Dental Simulations

Our dental/medical simulations are designed to:

• Improve your professional competence in a risk-free, simulated environment
• Allow you to experience rare scenarios, complications, and technical procedures you may not yet have faced
• Help you build muscle memory and decision-making skills safely

You acknowledge: These simulations supplement (not replace) formal clinical training. You will obtain formal professional certification from recognized authorities and practice only under supervision of licensed professionals.

Cybersecurity & Ethical Hacking — Acceptable Use Policy

Our Acceptable Use Policy is zero-tolerance.

Prohibited Activities:

• Port scanning or reconnaissance of external IPs (outside Simulpus environments)
• Attempting to hack systems you do not own or have permission to access
• Crypto-mining or resource hijacking
• Attempts to compromise Simulpus infrastructure
• Any activity that violates local, state, or international law

Consequences:

• Immediate permanent account ban without refund
• Forfeiture of all certificates and portfolio
• Session logs reported to relevant authorities (CERT-In, law enforcement)

You acknowledge: Simulpus cybersecurity training is for defensive security roles and authorized penetration testing only, not for malicious hacking.

Hardware Safety (Smart Ergonomics Kit)

• Smart Ergonomics Kits are for educational simulation only
• Do not modify, disassemble, or use kits for unauthorized purposes
• Follow all safety guidelines included with your kit
• Report any physical damage or malfunctions immediately to support@simulpus.org

What You Cannot Do

How We Detect Cheating

We monitor:

• Keystroke Velocity: Normal typing patterns vs. bot/copy-paste insertion
• Time-to-Solution Anomalies: Impossible solve speeds
• Telemetry Matching: Identical patterns between students

If flagged: We investigate logs, contact you for explanation, and determine the outcome.

Enforcement & Consequences

1. First Offense: Warning via email; account placed on probation
2. Second Offense: 72-hour account suspension
3. Severe Violation or Third Offense: Immediate permanent account deletion (Certificates revoked, Portfolio removed, Refund forfeited)

Collaboration Policy

You can discuss concepts with other students, but you must execute the lab yourself. The system grades your terminal session. If two students submit identical telemetry logs, both are flagged.

About Your Smart Physical Simulation Kit

For Instrument-Level Simulation Lab Programs, you receive a smart physical simulation kit developed exclusively for Simulpus through our R&D. In some cases, we co-develop kits with industry partners to ensure the highest quality and authenticity.

Each kit is custom-designed for your specific program and replicates professional tools and environments you'll encounter in real-world practice.

What's Included

Your kit includes components designed to capture and measure your performance:

• Custom 3D-printed simulation mockup (device-specific to your program)
• Embedded sensors for tracking movement, pressure, angle, stability, and other precision metrics
• USB connection module for seamless integration with the Platform
• Calibration software for initial setup and ongoing accuracy

Additional components vary by program. Check your specific Program Page for exact specifications, accessories, and what's included in your kit.

Warranty & Coverage

Warranty Period: Duration of your active program access, up to a maximum of 1 Year from kit delivery.

What's Covered:

• Electronic components (sensors, circuit boards, USB module) against manufacturing defects

What's NOT Covered:

• Physical wear and tear on consumables (simulation materials, cables, etc.)
• Damage from misuse, accidental drops, or unauthorized modifications
• Water damage or environmental exposure
• Normal cosmetic wear from regular use

Full warranty details are included on the warranty card shipped with your kit. Please review it for complete terms, as coverage specifics vary by product.

Defective Kit? Immediate Replacement Policy

If any physical simulation instrument is defective upon arrival:

• Raise a support ticket with video/photo evidence
• We will ship a replacement unit instantly within 24 hours
• Your "Fair Shot" refund window is paused until the new kit arrives
• You remain fully eligible to request a refund if you later decide the program isn't for you

A defective tool is an obstacle we solve, not a reason to quit the career path.

Kit Ownership & Use

You own the kit once delivered and enrolled. You can:

• Use it for Simulpus labs
• Use it for personal practice after program completion
• Resell it (Simulpus has no responsibility for used devices)
• Keep it indefinitely

You cannot:

• Disassemble or modify electronic components
• Use it for commercial purposes without permission
• Reverse-engineer sensors or firmware
• Hold Simulpus liable for damages from misuse

Replacement Parts, Consumables & Accessories

Replacement sensor kits, consumables, cables, and accessories are available for purchase from our internal store at student rates. Availability and pricing depend on your specific kit and program.

What Your Portfolio Is

Your Portfolio is a public-by-default professional profile that displays your verifiable skills and achievements (labs completed, performance score, precision metrics, etc.).

Privacy & Control

Default State: Your Portfolio is PUBLIC.

You can toggle to:

• Private (Password Protected): Only people you invite can view
• Private (Hidden): Not listed in search; direct link only
• Delete Permanently: Portfolio fully removed and cannot be recovered

Contact & Recruitment

• Your email and phone are NOT displayed
• Recruiters contact you through a secure contact form
• You control who to respond to
• Simulpus does not track recruiter visits or sell contact info

Portfolio Permanence

If you keep your account: Your Portfolio remains live permanently as read-only proof of your work.

If you delete your account: Your Portfolio is permanently deleted and cannot be recovered.

Your Work

You own all code, designs, solutions, and work product you create within Simulpus labs.

You can use in personal/professional projects, share publicly, and include in job applications.

You cannot claim Simulpus materials as your own, distribute lab instructions, or resell curriculum.

Simulpus Materials & Your Data

All Platform content is Simulpus proprietary.

You grant Simulpus a license to:

• Use anonymized behavioral data to improve AI Mentor
• Publish Aggregate Research
• Use anonymized solution snippets as "Model Examples"
• Display your Portfolio (with consent)

Response Times
